Parolee accused of past sexual assault

Rochester, N.Y. - He's accused of raping a 14 year old girl- just hours after his release from state prison. Now 13 WHAM News has learned this parolee has been accused of a sex crime before.
According to police reports a young woman accused Michael Caruthers of a sex crime in 2008 - when he was a teenager. The woman says she was forcibly touched during a robbery. The complaint says Caruthers "forcibly touched the intimate parts of the victim for the purpose of degrading the victim."
But the case never went any further. It is unclear why.
Other court papers allege that 10 days after the alleged sexual incident- Caruthers was under arrest for a series of other crimes. Police say while wearing a mask, he entered his mother's home, threatened her with a knife, stole her purse, then fled.
Paulette Johnson told police "The defendant's actions did make me fear for my life."
In order to get away, police say Caruthers carjacked another idling vehicle. In that car was a passenger- 23 year old Rebecca Fitzgerald. In her statement to police she said "I kept begging him to let me out but he kept going faster and faster. He didn't even slow down."
Fitzgerald says she was so afraid that she opened the door and jumped out of the moving car and ran while calling 911.
Court papers from Caruthers' arrest Saturday accuse him of threatening the life of his 14 year old victim and choking her. He approached the victim at the Liberty Pole, then allegedly forced her to have sex with him.
Police say he has admitted to the actions. All of this occurred just hours after his release from state prison on a second robbery conviction.
Caruthers served two terms in state prison and each time the parole board denied him early release citing his violent past and risk to the community. Many are wondering why he was released from prison in the first place.
In both cases, the parole board says by law they could not keep him any longer. However questions still remain about how he was or was not monitored after this release from prison.
