James Holmes in court for evidence hearings

Aurora, Colo. -- Colorado theater shooting suspect James Holmes was back in court Monday, as attorneys argue over what evidence to present to the jury.
Holmes has pleaded not guilty by reason of insanity to the July 2012 shooting. Twelve people were killed and dozens were hurt.

The two-week hearings will deal with motions to throw out evidence collected by investigators from Holmes' car and apartment. Defense attorneys argue that the evidence was collected in violation of Holmes' rights and should not be included in the trial.

The trial is set to start February 3, 2014.
