Blossom S. Nursing Home in jeopardy
Rochester, N.Y. - In another setback, a judge has ruled against Blossom South Nursing Home in a lawsuit over Medicare and Medicaid.
The setback could be devastating because it puts the nursing home in jeopardy of closing.
In a written statement, the nursing home said it would appeal the ruling.
According to the statement, "In the meantime, the 160 dedicated and compassionate staff members at the facility will continue their commitment to providing the highest level of care and support for our residents, and the owners will continue their efforts to keep Blossom South open."
A federal judge's decision this week allows the government to move forward with plans to cut off Medicare and Medicaid payments which would take away about 98 percent of Blossom South's revenue.
The owner of Blossom South says closure would eliminate 167 jobs and force 120 medically fragile patients to find new homes.
This is the second time in just a few weeks a judge has ruled against Blossom South.
Last month, a judge ruled that the government could penalize the nursing home for repeated citations from state inspectors.
It's still unclear what the next step will be, but in his decision, the judge said, "The process may not be over."
