Conviction upheld for Gates man who videotaped neighbor
Albany, N.Y. (AP) - New York state's highest court is upholding the criminal conviction of a Gates man for videotaping his neighbor when she opened her bathroom door after a shower even though he did it through her front window.
The Court of Appeals said the 2003 state law against so-called video voyeurism, called "Stephanie's Law" for a woman recorded by her landlord with a hidden camera, applies to what David Schreier did.
The seven judges unanimously reject Schreier's argument that standing on the front step of his neighbor's townhouse in Gates and filming through the window in her front door wasn't "surreptitious" as the law specifies.
The court also said someone's own bathroom is a place they should expect privacy.
Schreier, convicted at trial, was sentenced to five years' probation.
