Gun clerk takes stand in Nguyen trial

Rochester, N.Y. -- Jurors heard opening statements as well as witness testimony Monday morning in the trial of the woman accused of supplying guns to the man behind the deadly Christmas Eve ambush in 2012.

Dawn Nguyen is accused of lying on forms to buy guns which prosecutors allege she gave to William Spengler.

Spengler shot and killed his sister, set fire to her Lake Road home, then opened fire on responding firefighters. Two of those firefighters were killed and two others were injured.

Nguyen claims that the guns were stolen from her. She is not charged with any crimes related to the ambush.

The first witness the prosecution called to the stand was Antonio Garcia. He was the Gander mountain clerk who sold dawn Nguyen two guns.

Garcia testified William Spengler was with Nguyen that day. Prosecutors say he paid her $4 thousand to buy the guns.

900 days later the guns were found near Spenglers body after the Christmas Eve ambush.

Defense attorneys say Nguyen purchased the guns for herself for protection.

"She said (the guns) were stolen yet she never reported them," said prosecutor Tim Prosperi. "She said she purchased them for protection yet she never purchased ammunition.

An Alcohol, Tobacco, Firearms and Explosives agent also took the stand to testify about his role in tracing the serial numbers of the guns.
