Judge Astacio accused of violating probation
Rochester, N.Y. – Rochester City Court Judge Leticia Astacio is facing another allegation of violating the conditions of her probation sentence.
13WHAM has confirmed a violation complaint was filed against Astacio on Friday. The alleged violation stems from Astacio’s required ankle monitor detecting alcohol.
That violation reportedly happened on Friday, July 14.
The probation department conferred with the manufacturer of the device and said the readings are consistent with alcohol consumption.
Astacio is due back in court Thursday to answer to the complaint.
The City Court judge was sentenced to 60 days in jail, three years’ probation and six months with an alcohol ankle monitor last month in connection with violations of the conditions of her DWI conviction.
Astacio filed an appeal to have the conditions of her sentence – including the ankle monitor – suspended pending an appeal of her conviction; that appeal was denied by Judge William Kocher.
