Astacio case to be heard by NY's highest court in September

Albany, N.Y. (WHAM) - The case to remove Leticia Astacio from the bench as a Rochester City Court judge will be heard by the New York State Court of Appeals.

New York's highest court will hear oral arguments about the State Commission on Judicial Conduct determining whether to remove Astacio from office.

Astacio filed an appeal with the court, countering the Commission's recommendation that she be removed from the bench.

The hearing is scheduled to be heard on Wednesday, September 5. The Court is scheduled to convene in Albany at 2 p.m.; the Astacio case will be the second matter discussed.

In April, the New York State Court of Appeals suspended Astacio with pay . She submitted a letter to the state's highest court, recommending why she should continue to draw her $187,200 annual salary while she is suspended. On May 8, her letter was affirmed and her suspension remains in place with pay.

Her current term expires on December 31, 2024.
