Greece/Rochester, N.Y. (WHAM) - A grand jury in Monroe County declined to indict a Greece police officer for shooting an 81-year-old man in April.

According to the Monroe County District Attorney's Office, the grand jury declined to indict Greece Police Officer Jeffrey Fraser for the death of Robert Litolff.

Police say in the early morning hours of April 5, officers responded for the report of a man saying he was going to kill his wife at his home on Betwood Lane.

When Officer Fraser responded, Litolff pointed a .22 caliber rifle at him. Fraser fired 17 shots at Litolff, hitting him twice - once in the foot and once in the chest. Litolff died from the gunshot wound to the chest.
