Judge Leticia Astacio's new lawyer confirms to 13WHAM News that he has filed a motion to immediately terminate her probation.

Gregory Salmon is now representing Astacio and says he has proof his client was abstaining from drinking.

Salmon says he has filed a toxicology report with the court, including a hair follicle test that he says proves Astacio wasn't drinking on May 30 and 90 days before that.

During those 90 days, Judge Astacio was in Thailand. Salmon says these tests prove she had not been drinking at all, but was handed down tougher probation on the grounds she was drinking.

Judge Astacio is scheduled to be arraigned October 23 on an allegation she violated her sentence again by leaving the county to go to Del Lago resort and casino.
