Rochester, N.Y. (WHAM) - A Rochester man was sentenced in federal court on Monday for illegally possessing a handgun.

Anthony Alberti, 36, was sentenced to 2 1/2 years in prison for being a prohibited person in possession of a firearm.

On June 28, Alberti hailed an Uber and asked to be taken to the FedEx facility on Manitou Road. At the facility, he picked up a package and took what appeared to be a 9 mm handgun, according to court documents. The driver said Alberi put the magazine in the gun and asked to be taken to the Northgate Walmart on Dewey Ave in Greece to “pick up rounds.”

Once Alberti was at the store, the driver called 911.

Alberti was later arrested on July 14 and charged with third-degree criminal possession of a weapon. He claims he had a woman ship him a nail gun and he didn’t realize it was a real gun until he opened the package.

Greece Police worked with the ATF to make the arrest.
