Woman killed in Dansville crash while fueling up car

Dansville, N.Y. - State Police are investigating a fatal crash in Dansville where a woman was hit and killed Wednesday night after her car ran out of fuel.

Authorities say around 6:45 p.m., 44-year-old Shawn Martinez pulled to the side of Route 63 after her vehicle ran out of gas.

Martinez got out of her vehicle, which investigators said was also partly in the roadway and did not have any hazard lights on.

As she got a gas can out of the car and started to fill up the tank, another car approached from the south. The driver, 20-year-old Payton Rider, could not see Martinez's vehicle due to the lack of lights and tried swerving around it, but was unsuccessful.

Martinez was hit by Rider's vehicle and seriously injured.

Rider was uninjured in the crash. A passenger in Martinez's vehicle, 28-year-old Joshua Clark, was also uninjured.

Martinez was taken to Noyes Hospital and pronounced dead.

At this point, no charges are being filed, but the investigation is ongoing.
